Bankruptcy and Divorce (April 27, 2017)

Topic Summary:

This CLE will consider the implications that bankruptcy has on divorce proceedings. Subjects that will be discussed include what portions of a divorce proceeding can continue in light of a bankruptcy action compared to those aspects which must be stayed pending resolution of the bankruptcy matter.  In addition, the CLE will consider the assets and liabilities of a party in a divorce action, what assets become part of the bankruptcy estate and what liabilities are discharged and not discharged in bankruptcy.  These topics will be considered with both a Chapter 7 liquidation and a Chapter 13 reorganization in mind.
