Commercial Damages: Lost Profits Analysis

Lost profits is a damages remedy that a business can recover when a legal wrong has caused it to suffer lost profits. Lost profits can simply be described as the amount necessary to place the injured party in a position that it would have been had the injury/incident not occurred.
This presentation will cover the common elements of lost profits damages claims, including: proximate cause, foreseeability, reasonable certainty (established business vs. the new business rule), mitigation. The types of claims for which lost profits damages are potentially available include torts, breach of contract, infringement of intellectual property and other causes. A discussion of the methods of calculating lost profits will be presented along with the types of documents necessary for the calculations.
Live case studies of lost profits will also be presented and discussed.
